The general terms and conditions of sale exclusively apply to the commercial relations between Erlo Taladros y Roscadoras S.L.U., with Tax no. B20993440 and their registered office at Txerloie Auzoa, nº 3, 20720 Azkoitia (Spain), and the physical legal person or representative of the legal person signing the order form.
Erlo Taladros y Roscadoras S.L.U. reserves the right to change these terms and conditions without prior notice. Were a court to declare any article of these terms and conditions of sale to be illegal, void or unenforceable, for any reason whatsoever, said article would be dissociated from the others, all of which would maintain their full validity.
These terms and conditions define the modalities of sale between Erlo Taladros y Roscadoras S.L.U. and the customer, from the order to the services, including payment and shipping.
1. Acceptance of the terms and conditions
These terms and conditions of sale govern the contractual relations between Erlo Taladros y Roscadoras S.L.U. and their customer, who states that they are familiar with said T&Cs when placing their order and expressly accept them with no reservations.
Clicking on the button to place their order also implies validation of their order as well as full and unreserved acceptance of these terms and conditions of sale. Your order will not be fully accepted until Erlo Taladros y Roscadoras S.L.U. sends the confirmation email.
2. Articles
2.1. Article presentation
The essential characteristics of the products on sale can be found on our website, where they are described in detail.
If, despite our extreme precautions, any kind of error were to occur, Erlo Taladros y Roscadoras S.L.U. would pay no compensation. The information contained in these pages is provided solely by way of an example. The products may be modified without prior warning by Erlo Taladros y Roscadoras S.L.U. when considered necessary to improve the product quality.
2.2. Product prices
The product prices appear in Euros including Spanish VAT. All increases or decreases in VAT will be reflected in the product prices.
The prices can be changed at any time without prior notice.
All payments must be made in euros.
3. Price validity
The articles will remain on sale while stocks last. For commercial articles not in stock at our warehouses, the prices are valid subject to the availability of our suppliers. The customer will be notified by email or telephone as soon as possible. You can ask to have your order cancelled or changed by writing to the email erlogroup@erlogroup.es, or by calling 943 85 18 58. In the event of the product being discontinued, your order will be cancelled.
4. How to place an order
4.1. Online
Automatic recording systems are deemed to provide valid proof of the nature, content and date of an order. The sale will be binding from the moment your order is accepted, or validated online when secured by your chosen payment system. Erlo Taladros y Roscadoras S.L.U. reserves the right to cancel any order placed by a customer with whom a dispute exists regarding the payment of an earlier order. Were the customer to enter the wrong address when completing the information required to place their order, the seller would not be held liable for the eventual impossibility to deliver the product. In the event of having to change the delivery address, the cost of carriage would be paid by the customer.

5. Payment/Billing
5.1. Payment methods
You can choose your preferred payment method from those available at the moment of making your purchase; these may be one or several of the following:
Whatever the chosen payment method, you will receive an invoice with your order. Indication of the VAT amount gives collectives, companies and liberal professionals the possibility of its recovery.
5.2. Delayed payment
In the event of delayed payment Erlo Taladros y Roscadoras S.L.U. reserves the right to cancel all orders placed, without prejudice to the taking of any other action. Any amounts not paid on the date of maturity indicated on the invoice will imply the full right to apply sanctions of an amount equal to twice the legal interest rate, calculated monthly. Said sanctions will be enforceable upon demand by Erlo Taladros y Roscadoras S.L.U..
In the event of failure to pay amount due within the time agreed to, 48 hours after the notice of claim has failed to obtain results, Erlo Taladros y Roscadoras S.L.U. will have the full right to cancel the sale. The customer will have to repay all expenses produced by the procedure to claim the amount due.
6. Reservation of ownership and liability
The products will remain the property of Erlo Taladros y Roscadoras S.L.U. until full payment has been received from the customer. The products become the property of the customer immediately they have paid the full price. In addition, the risk of loss, robbery or breakage during transport are the customer’s liability.
Failure by the customer to fulfil their payment obligations, no matter what the reason, gives the Erlo Taladros y Roscadoras S.L.U. the right to demand immediate return of the goods, the cost of which will be paid by the customer. Likewise, the customer is liable for the risks of loss, theft or breakages during transport when the haulier has not been contracted through Erlo Taladros y Roscadoras S.L.U..
7. Shipping
7.1. Shipping method and costs
Once the order has been confirmed, Erlo Taladros y Roscadoras S.L.U. will deliver the order requested by the buyer to the haulier in the shortest possible time. The haulier has the responsibility, by means of a contract with Erlo Taladros y Roscadoras S.L.U., to deliver the order to the address provided by the customer.
For all shipments outside mainland Spain and the Balearic Islands, the customer will pay for all documents, import duties, custom duties, VAT and any other tax legally required in the country or community receiving the order.
Shipping costs may change according to the haulier’s rates. The customer will be liable for different options involving requests for deliveries at specific times or on specific dates, always depending on the delivery zone.
7.2. Delivery conditions
The delivery conditions for our products are governed by the General Terms and Conditions of Carriage according to the type of service used, which must be published on the haulier’s website.
7.3. Delivery time
The delivery period starts counting from the moment the product has been fully manufactured; the estimated delivery time from then on is 1-10 working days, depending on the shipment destination. This time may be shorter or longer depending on the chosen delivery conditions. The shipment details are provided solely by way of an example and do not imply any kind of liability on our part. Erlo Taladros y Roscadoras S.L.U. will not accept penalties or claims for compensation.
7.4. Claims
In order to have the right to make any kind of claim for damage, the customer is responsible for examining the condition of the packaging and making the pertinent comments on the delivery note, in the haulier’s presence, at the moment of receiving the order. Said comments must be sent to Erlo Taladros y Roscadoras S.L.U. at the email erlogroup@erlogroup.es within 24 hours from receiving the order; failure to comply with this deadline means that the complaint will no longer be valid. By signing the delivery note, the customer accepts the articles sent in the condition they arrive; no further complaints will be accepted in regard to damage suffered during transport.

This contract is subject to Spanish law. Erlo Taladros y Roscadoras S.L.U. refuses all liability for any material or immaterial damage or bodily harm resulting from malfunction or inappropriate use of the articles commercialised. The liability of Erlo Taladros y Roscadoras S.L.U. will, for all complaints, be limited to the cost of the order; no liability will be accepted for claims made due to simple errors or omissions potentially observed in the product presentation despite the precautions taken.
In the event of complaints, the customer must first of all contact Erlo Taladros y Roscadoras S.L.U. in the endeavour to reach an out-of-court settlement. In the event of being unable to solve disputes out of court, recourse will be taken to the Courts and Tribunals of the city of San Sebastián, with express waiver of any other jurisdiction corresponding to the accepted place of delivery and payment method.
10. Warranty and After Sales Service
Erlo Taladros y Roscadoras S.L.U. undertakes to send any component to be changed during the warranty period within 24/48 hours from the moment of receiving the faulty part or a digital photograph of the same, giving the serial number and a description of the product in question.
In any event, Erlo Taladros y Roscadoras S.L.U. accepts no liability for not respecting the regulations and laws in place in the country receiving the goods. The liability of Erlo Taladros y Roscadoras S.L.U. is systematically limited to the value of the product for which the claim is being made.
